1. AGREEMENT TO TERMS

By accessing our website (mcbr.net) or using MCBR's mobile car battery replacement and jump start services, operated by ISBMA Transportation Inc., you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms constitute a legally binding agreement between you ("Customer") and Mobile Car Battery Replacement ("Company," "we," "us," or "our").

2. SERVICES PROVIDED

MCBR provides the following mobile automotive services:

  • Car Jump Start: Emergency battery jump start services
  • Battery Replacement: On-site car battery testing and replacement
  • Vehicle Health Check: Basic diagnostic services to identify battery and electrical issues

All services are performed at the customer's location within our service area.

3. SERVICE AREA & AVAILABILITY

MCBR primarily serves Baltimore County and surrounding areas in Maryland. Service availability outside this area is subject to confirmation and may incur additional travel fees.

We operate 7 days a week from 7AM to 10PM. After-hours service may be available upon request — please call to confirm availability.

4. RESPONSE TIME

We strive to provide prompt service with an average response time of 10 minutes for emergency calls within our primary service area. However, response times may vary based on:

  • Current demand and technician availability
  • Traffic and weather conditions
  • Distance to your location
  • Time of day

Note: Response times are estimates and not guaranteed. We will communicate estimated arrival time when you call.

5. PRICING & PAYMENT

Payment Methods: We accept cash, credit cards, and debit cards. Payment is due upon completion of service unless otherwise agreed upon in writing.

No Call-Out Fee: We do not charge a fee for coming to your location. You only pay for services rendered.

Quote Accuracy: All quotes provided are estimates based on information provided by the customer. Final pricing may change if actual conditions differ from what was described (e.g., different battery size required, additional issues discovered).

6. CANCELLATION & NO-SHOW POLICY

Free Cancellation: You may cancel a service request at any time before the technician arrives at no charge.

Late Cancellation: If you cancel after the technician has arrived at your location, a cancellation fee of up to $35 may apply to cover travel costs.

No-Show: If you are not present at the scheduled location when our technician arrives, we will attempt to contact you. After 15 minutes of waiting, we reserve the right to leave and may charge a no-show fee of $35.

7. LIMITED WARRANTY COVERAGE

All batteries we install carry a 3-5 year manufacturer warranty. However, MCBR provides a 3-Month Installation Warranty because battery performance depends on factors beyond our control.

Why Only 3 Months?

Battery lifespan depends on:

  • Your driving habits and frequency
  • Vehicle electrical system health (alternator, wiring, etc.)
  • Parasitic drains from aftermarket accessories
  • Weather and storage conditions

Since we cannot monitor or control these factors after installation, our warranty covers the first 3 months to ensure proper installation and initial battery performance.

📝 Odometer Recording: Our technician records your vehicle's mileage at the time of installation. This reading is used to verify warranty eligibility for any future claims.

Minimum Driving Requirement

⚠️ Important: To maintain warranty coverage, your vehicle must be driven a minimum of 600 miles per month (approximately 150 miles per week or 20+ miles per day).

Batteries require regular charging through driving. If your warranty claim shows insufficient mileage based on our installation odometer reading, the warranty will be void.

Simple rule: Drive your car at least 20-30 minutes, 3-4 times per week.

What's Covered:

  • Manufacturing defects in materials or workmanship
  • Premature battery failure under normal use
  • Replacement battery only — no labor reimbursement

Warranty Claim Requirements:

  • Valid proof of purchase or receipt
  • Odometer reading showing minimum 600 miles/month driven
  • Battery tested at authorized location (AutoZone, Advance Auto Parts, etc.)

Special Warranty Terms for Commercial Use:

Vehicle Type Warranty Period
Standard personal vehicles 3 months
Taxis, rideshare, heavy equipment, tractors, commercial machinery 12 months (due to high-demand usage)
Start-Stop or AGM batteries for taxi use Up to 3 years manufacturer coverage

8. WARRANTY EXCLUSIONS & VOIDING CONDITIONS

Important: Customers who do not comply with these terms will be charged the full replacement cost of a new battery.

The warranty will be void under the following conditions:

  • The battery has been removed, opened, or tampered with by anyone other than our authorized technician
  • The battery was installed or serviced by another mechanic or shop after our installation
  • The vehicle has expired registration, inspection, or mechanical condition contributing to the failure
  • The battery failure is caused by non-factory modifications, aftermarket accessories, or improper installation
  • The battery has been misused, neglected, or exposed to abnormal conditions (over-discharge, over-charge, deep cycling, or extended inactivity)
  • The battery voltage has been allowed to discharge below 10.60V

9. EXCLUDED CAUSES OF FAILURE (NOT COVERED)

This warranty does not cover failures resulting from any of the following:

  • Incorrect or undersized battery installed in a vehicle
  • Faulty alternator or charging system (over-charge or under-charge)
  • Prolonged storage, minimal driving, or infrequent battery use
  • Electrical shorts, faulty wiring, or excessive electrical loads
  • Modifications to terminals or connectors
  • Deep discharge or excessive cycling (batteries repeatedly drained below 12.1V)
  • Physical damage, corrosion, or neglect
  • Parasitic drain from vehicle electrical systems

Non-Manufacturing Faults:

The following conditions are not considered manufacturing defects and are therefore excluded:

  • Sulphation: Occurs when the battery is left discharged or unused for long periods (below 12.06V)
  • Overcharging: Caused by a faulty alternator or voltage regulator
  • Physical damage: Cracks, melted terminals, or improper installation
  • Wear and tear / deep cycling: Due to frequent discharging and recharging beyond normal use
  • Incorrect application: Use of a battery not rated for the specific vehicle type or purpose

10. MANUFACTURER WARRANTY

In the event of a product defect covered under manufacturer warranty, customers must contact us first.

Our team will assist in diagnosing the issue via phone, email, or an in-person inspection. We may ask for voltage and CCA (Cold Cranking Amps) test results to confirm eligibility.

Note: Manufacturer warranties are non-transferable and apply only to the original purchaser.

11. WARRANTY TESTING & CLAIM PROCESS

Before a replacement can be issued, customers must follow this process:

  1. Get the battery tested (voltage and CCA) at a local auto parts store or service center (e.g., AutoZone, Advance Auto Parts, Pep Boys)
  2. Obtain test results showing that the battery is defective, not simply discharged or drained by the vehicle
  3. Contact us with your proof of purchase and test results
  4. Schedule inspection if required by our technician

We do not cover failures caused by alternator malfunction, parasitic drain, or vehicle electrical issues. Test results must confirm a manufacturing defect.

12. MILEAGE REQUIREMENTS & LOW-USAGE VEHICLES

Minimum Driving Requirement:

Odometer Verification: At installation, we record your vehicle's odometer reading. For warranty claims, we compare your current mileage to the installation reading. If the difference shows less than 600 miles/month average, the warranty is void.

Example: If battery installed at 50,000 miles and warranty claim made at 51,200 miles (3 months later), that's only 1,200 miles in 3 months = 400 miles/month = warranty void (below 600 mile minimum).

Low-mileage drivers: If you drive less than 600 miles/month, you must use a battery maintainer/charger to keep the battery charged. Failures from under-use are not covered under warranty.

Batteries require regular use to maintain proper charge levels. Vehicles that sit idle for extended periods will experience accelerated battery degradation — this is not a manufacturing defect.

13. BATTERY MAINTENANCE RECOMMENDATIONS

To maximize battery life and maintain warranty coverage, we recommend:

Regular charging Recharge at least once per month if vehicle is rarely driven
Avoid deep discharge Do not allow battery to discharge below 10.60V (voids warranty)
Leisure batteries For motorhomes, boats, caravans — maintain regular charging to prevent sulphation
Terminal care Keep terminals clean and free of corrosion
Secure mounting Ensure battery is properly secured to prevent vibration damage

14. CUSTOMER RESPONSIBILITIES

As a customer, you agree to:

  • Provide accurate vehicle information (make, model, year, location)
  • Ensure safe access to your vehicle for our technician
  • Be present during the service or designate an authorized representative (18+ years old)
  • Inform us of any known vehicle issues that may affect service
  • Provide a safe working environment (well-lit, level ground, away from traffic)
  • Make payment upon completion of service
  • Keep proof of purchase/receipt for warranty claims
  • Follow maintenance recommendations to preserve warranty

15. VEHICLE CONDITION & RIGHT TO REFUSE SERVICE

Our technician will perform a basic assessment before beginning work. If we identify issues beyond a battery problem (such as alternator failure, electrical shorts, or other mechanical issues), we will inform you before proceeding.

We reserve the right to decline service if:

  • The vehicle is in an unsafe condition
  • The working environment poses a safety risk to our technician
  • The required service is beyond our scope of expertise
  • The customer is uncooperative, abusive, or under the influence
  • The vehicle location is inaccessible or hazardous
  • We suspect the vehicle may be stolen or involved in illegal activity

16. LIMITATION OF LIABILITY

This warranty covers battery replacement only.

MCBR and ISBMA Transportation Inc. shall not be liable for:

  • Pre-existing vehicle conditions or damage
  • Electrical system issues not caused by our services
  • Damage resulting from incorrect information provided by the customer
  • Indirect, incidental, or consequential damages
  • Loss of use of vehicle during or after service
  • Data loss in vehicle computer systems
  • Loss of income, business opportunities, or profits
  • Labor costs, towing fees, or vehicle downtime
  • Any damages exceeding the cost of the service provided

No refunds or cash reimbursements will be issued under any circumstances. Our total liability for any claim shall not exceed the amount paid for the specific service in question.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MCBR, ISBMA Transportation Inc., and its owners, employees, technicians, and agents from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:

  • Your use of our services
  • Your violation of these Terms and Conditions
  • Inaccurate information you provided
  • Your negligence or misconduct
  • Any third-party claims related to your vehicle

18. INTELLECTUAL PROPERTY

All content on the MCBR website, including text, graphics, logos, images, and software, is the property of ISBMA Transportation Inc. and is protected by copyright laws. You may not reproduce, distribute, modify, or use any content without our written permission.

19. DISPUTE RESOLUTION & GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws principles.

Any disputes arising from these terms or our services shall:

  1. First be addressed through good-faith negotiation between the parties
  2. If unresolved, be submitted to mediation in Baltimore County, Maryland
  3. If still unresolved, be resolved through binding arbitration or in the appropriate state or federal courts located in Baltimore County, Maryland

20. CHANGES TO TERMS

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with an updated "Effective Date."

Your continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.

21. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

22. ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and MCBR regarding your use of our services. Any prior agreements, representations, or understandings are superseded by these terms.
